    Vijay’s TVK Moves Madras High Court Challenging SOP for Political Rallies, Raises Free Speech Concerns

    Actor Vijay’s political party, Tamilaga Vettri Kazhagam (TVK), has approached the Madras High Court challenging the Standard Operating Procedure (SOP) issued by the Tamil Nadu government for regulating public meetings and political rallies.

    The petition, filed through TVK Joint General Secretary CTR Nirmal Kumar, seeks modification of the SOP, contending that it gives undue priority to political parties recognised by the Election Commission while imposing restrictive conditions on newly formed and unrecognised parties.

    Key Concerns Raised

    • The SOP allegedly creates an unequal playing field among political parties, violating democratic principles.

    • Preference to recognised parties is said to be arbitrary and discriminatory, especially against emerging political movements.

    Free Speech & Constitutional Challenge

    TVK has argued that the SOP infringes the fundamental right to freedom of speech and expression under Article 19(1)(a) of the Constitution.

    Political rallies and public meetings are described as essential tools for political communication, particularly for new parties seeking to reach the electorate. Excessive executive control through the SOP, the plea states, amounts to unreasonable restrictions on free political expression.

    Relief Sought from the Court

    TVK has urged the Madras High Court to strike down or suitably modify the SOP to ensure:

    • Equal treatment of all political parties, and

    • Protection of democratic participation and free speech, irrespective of recognition status.

    The case is likely to have wider implications for political activity, public assemblies, and freedom of expression in Tamil Nadu.
